Preparing the Application for Consent Orders & Consent Orders - Financial & Parenting Orders

Congratulations for arriving at a negotiated outcome without litigation. Having financial and property orders made by consent gives you certainty and finality in relation to your financial circumstances and the arrangements for the children, allowing you to move forward as a family unit even though you are now split over two homes

This product has been developed to assist parties to document their financial and parenting agreements which you will then lodge with the Court.  You will receive:

  • A completed Application for Consent Orders;
  • Financial and Parenting Orders which are enforceable and can be actioned;
    • Financial Orders which comply with the Laws required to avoid stamp duty on the transfer of existing assets;
    • Financial Orders which ensure you are indemnified in relation to liabilities incurred during the relationship, including by either party, jointly or through any entity, and including taxation that may be later assessed;
    • Superannuation splitting orders (if that is part of your agreement);
    • A letter to the Superannuation Trustee seeking consent to the Orders you have agreed.
    • Parenting orders addressing your agreement about one or more of the following:
      • who the child/ren will live with
      • how much time the child/ren will spend with each parent and with other people, such as grandparents and when time will be spent including special occasions like Christmas and birthdays
      • the allocation of parental responsibility
      • how the child/ren will communicate with a parent they do not live with, or other people
      • any other aspect of the care, welfare or development of the child.
  • Instructions about how to lodge the documents with the Court in the form of a checklist

When you pay for the service, we will send you a link (next business day) so we can obtain information from you, and arrange a time to meet with you over Zoom so we can discuss the Orders to be prepared.  We will then get the process underway.
