Most separating couples agree on how to divide their property and finances without going through the family courts.  Agreeing on a property split without disputing the issues in court saves families the emotional and financial costs associated with a contested hearing, and gives parties greater autonomy over how they divide their property.

Arriving at a negotiated outcome without going through the courts often results in better post-separation parenting relationships for couples with children. Having property orders made also gives you certainty and finality in relation to your financial circumstances, and you can move on without the risk of having to further divide your assets in the future.

Given these benefits, we encourage separating parties to finalise their property and financial arrangements outside of the court, where it is safe and appropriate to do so.

Comprehensive Document Options: The Separation Suite offers three key document creation options for when you have agreed on a settlement:

  • Application for Consent Orders – Financial:  $1,895 plus GST
  • Application for Consent Orders – Parenting Only: $2,295 plus GST
  • A combined Application for Consent Orders - Parenting and Financial: $3,495 plus GST 

Consent orders are written agreements in which you and your Ex agree on and ask the Court to formalise as court orders. Once we have drafted your documents, You can apply to the Court for consent orders to be made without actually going to or appearing in court.

You can make consent orders for both parenting and/or financial arrangements at the same time in the one application. The Orders sought meet the criteria set out in the Family Law Act 1975 for being in the best interests of the children and just and equitable in relation to financial matters. The Court cannot make orders that don’t meet that criteria, even if everyone else agrees.

By creating settlement documents which comply with Australian law, the settlement documents can be made into consent orders by the Court, and operate so you can transfer and sell assets, discharge debts, and divide superannuation between you, avoiding stamp duty along the way.  They also ensure the parenting orders provide a clear framework for the time the children will spend with each parent including on special occasions like Christmas, birthdays and religious and cultural events.

They bring a wealth of knowledge to the table, ensuring that every piece of information needed for your documents is captured accurately.
